Authorization and release from liability for participation to in-person soccer program

The French Griffons is allowing a limited number of its Players to participate to its soccer program during the school year 2021-22.

The undersigned is/are the Parent(s)/Legal Guardian(s) (the “Parents”) of the player(s) (“Player(s)”) of The French Griffons listed above who will be attending in-person soccer program ( "Program(s)”) during the school year 2021-22. In consideration for Player’s participation in such Program, Parents, on behalf of themselves and on behalf of the Player, hereby agree to the terms and conditions below:  

1. Voluntary Participation: Parents understand that the Player’s participation in any in-person Program is entirely voluntary and is not required for the Player’s continued enrollment or continued participation in The French Griffons’ programs.

2. Adherence to Safety and Health Guidelines:  Parents understand and acknowledge that The French Griffons has implemented safety and health guidelines that require all Players participating to in-person Programs to observe certain practices and precautions designed to mitigate the risk of spreading COVID-19. Parents acknowledge and agree that the Player will abide by the such guidelines, including but not limited to the following:    

a) Parents understand that The French Griffons will designate specific time blocks for the Player’s participation in the Program.  Parents understand and agree that the Player may only be on the soccer field during the time of such designated time blocks, and must promptly leave the soccer field upon completing the Program taking place during such time blocks.  

b) Parents understand and agree that the Player may not participate in any Program if any member of their household or other individual with whom they have recently been in close contact has received a positive diagnosis of COVID-19 within the fourteen (14) day period immediately preceding any such Program, or otherwise is or has exhibited the symptoms of COVID-19 within the fourteen (14) day period immediately preceding any such Program. Should the Player be exhibiting any symptoms of COVID-19 when he/she reports to The French Griffons, the Player will be promptly sent home and may not return until he/she has tested negative for COVID-19 and/or has been without symptoms for a fourteen (14) day period.  Parents understand and agree that, if the Player is not otherwise able to return home, that Parents will pick the Player up at The French Griffons’ soccer field within an hour of being notified that the Player is exhibiting symptoms of COVID-19.

c) Parents understand and agree that the Player must wear a face mask at all times during the Program.  Failure to arrive with and consistently wear a face mask as described may result in The French Griffons denying Player’s ability to participate in the Program.  

d) Parents understand and agree that the Player will follow all instructions of The French Griffons while participating to the Program, including by observing physical distancing, frequent hand washing and/or use of hand sanitizer and any other safety and health guidelines The French Griffons may implement.  
 
e) Given the community spread of COVID-19, Parents understand and agree that they and the Player are expected to follow additional safety protocols while the Player is not participating to the Program.  Specifically, all families are expected to adhere to the directives of applicable federal, state, and local government health departments, including the CDC regarding social distancing in public and other measures to reduce the spread of COVID-19. Parents and the Player are expected to avoid unnecessary travel. If anyone in the Player’s household has traveled to a COVID-19 hot spot, as designated by the CDC, Parents are required to notify The French Griffons and the Player may not participate in the Program for at least fourteen (14) days after returning from such travel.   

3. Recognition and Assumption of Risk: Parents understand that the current situation has been declared a worldwide pandemic by the World Health Organization. Parents further understand that COVID-19 is extremely contagious and is believed to spread by person-to-person contact; and, as a result, federal and state health agencies recommend social distancing and various other measures to mitigate the risk of contracting the virus. Parents acknowledge that The French Griffons has implemented reasonable preventative protocols, policies and procedures designed to reduce the spread of COVID-19 during the Player’s participation in the Program.  Parents have discussed this with the Player and acknowledge the Parents’ and the Player’s shared responsibility to adhere to these protocols in order to reduce the risks of contracting or spreading the virus while the Player is participating in Program. 

4. Despite the protocols and procedures in place to mitigate the transmission of COVID-19 on campus, Parents understand and acknowledge there are inherent risks that they or the Player may become infected with COVID-19 due to the Player’s participation in the Program.  These risks include, but are not limited to, the following: exposure to COVID-19, becoming infected with COVID-19, or becoming a symptomatic or asymptomatic carrier of the virus.  It is possible that the Parents and/or the Player are already asymptomatic carrier(s) of the virus and that the Player may infect other Players, employees, or other individuals at The French Griffons as a result of his/her participation in activities. Parents understand that their or the Player’s possible exposure to COVID-19 may result in Parents or the Player spreading the infection to other family members or other persons.  Parents recognize that any person who receives a positive diagnosis of COVID-19, including the Player or another family member, may encounter extended quarantine/self-isolation, additional tests, medical care, hospitalization, other potential complications, and the risk of death.  Parents hereby acknowledge and assume the risks of they or the Player becoming infected with COVID-19 as a result Player’s participation in activities.  

5. Center for Disease Control and Prevention Information:   Parents have reviewed applicable current information regarding COVID-19 and precautionary measures published by the Center for Disease Control and Prevention (www.cdc.gov/coronavirus/2019-ncov/community/schools-childcare), as well as state and local health departments, and are permitting the Player to participate in the Program with a full understanding of such information.  Parents acknowledge that they discussed this information with the Player, who agrees to participate in the Program with an understanding of that information. 

6. Waiver and Release of Liability:  As discussed above, participation in programs during the duration of the COVID-19 pandemic creates the risk that Parents and/or the Player could be exposed to COVID-19. Parents release The French Griffons, its administrators, employees, contractors and agents from all claims, liability and damages that Parents or Player may have for personal injuries, illnesses, medical expenses, or other loss resulting from the Player’s participation in Program. Parents agree that this release includes personal injury, illness, medical expenses, or other losses caused by or resulting from negligence, active or passive, of The French Griffons, its administrators, employees, contractors and agents; however the release does not apply to liability for gross negligence, willful injury, or fraud, and is not intended to release The French Griffons’ insurers, if any, or non-agent third parties of any responsibility for any claims that may otherwise be asserted. 

7. Miscellaneous:   The releases contained within this Authorization and Release from Liability are for the benefit of The French Griffons and are binding on the Parents, their heirs, beneficiaries, legal representatives, executors, administrators, and assigns.  This Authorization and Release from Liability shall be governed by the laws of the State of Maryland.  If any clause, sentence, paragraph or other provision of this Authorization and Release from Liability is, for whatever reason, deemed void, or otherwise unenforceable, then such language shall be severed and the rest of the Authorization and Release from Liability shall remain in full force and effect.  
By signing this Authorization and Release from Liability, Parents acknowledge and represent that they have read the Authorization and Release from Liability, fully understand it and agree to its provisions, and sign it voluntarily as their own free act on behalf of themselves, and, if applicable, as the parent or legal guardian of the Player, on behalf of the Player.  Each Parent should sign this Authorization and Release from Liability; however, it may be signed by a single parent or guardian who has the authority to enter such agreements on behalf of the Player and/or the consent of all other parents or guardians to do so.  The submission of the Authorization and Release from Liability with the signature of a single Parent will constitute the representation of that Parent that they have the necessary authority and consent.  No oral representations, statements, or inducements apart from the foregoing Authorization and Release from Liability that has been reduced to writing have been made and no modifications or alternations may be made to this form.

Your typed name and date will together serve as your signature for this Electronic Authorization and Release from Liability. The electronic signature below and related fields are treated by My French Classes like a physical handwritten signature on a paper form as if actually signed by you in writing. Further, you agree that no certification authority or other third party verification is necessary to validate your electronic signature, and that the lack of such certification or third party verification will not in any way affect the enforce ability of your signature or any resulting contract between you and My French Classes.
